These Terms and Conditions of Use for all Videoo.tv products and services, including the site https://videoo.tv/ and all its content.

By using this website, the user accepts and agrees to these terms and conditions, as well as any policies that may be added or any changes to which they may be subject. If you do not agree, we recommend that you do not use the site, its products or services. Videoo.tv reserves the right to update the Terms and Conditions at any time and at its sole discretion, to take into account legal or business issues. Users will be notified of an update to the Terms and Conditions
will be notified by e-mail. The effects of the changes will take effect at the same time they are updated.

CONDITIONS OF ACCESS AND USE

By accessing and using the Website and the Platform, it is understood that the user expressly declares his/her acceptance of the content of each and every one of these conditions, the legal notice, the privacy policy and the cookies policy.

The access to the Web and the Platform is made under the own and exclusive responsibility of the user, who will respond in any case of the damages that such access could cause. The access to the Web is free of charge and browsing it does not require prior subscription or registration. The access to the Platform requires prior acceptance.

The user agrees to use the Web and the Platform, the contents and services offered therein in accordance with the law and these conditions, good faith, good customs and public order. The user acknowledges and accepts that certain actions may be carried out by third parties (collaborators).

If the requested data is not provided or if the applicable data protection policy is not accepted, Videoo.tv will not be able to provide the user with the answer to his request.

The user of the Platform (Publisher) must have a web page with a privacy policy. The user must comply with the current legislation regarding data protection, GDPR, CCPA or the one that may correspond to its location or an update of these, being the user/publisher the only responsible for this legislation is met, Videoo.tv thus disclaims any responsibility for non-compliance with these.

VIDEOO.TV CONTENTS – INTELLECTUAL PROPERTY

All contents of Videoo.tv, unless otherwise indicated, are the exclusive property of Videoo.tv or third parties who have authorized their inclusion therein.

Likewise, all trade names, trademarks or distinctive signs of any kind contained in the Web and the Platform are protected by law and their reproduction, imitation, use or insertion without due authorization by Videoo.tv is prohibited.

The user acknowledges that the unauthorized reproduction, distribution, commercialization or transformation of the indicated elements may constitute an infringement of the intellectual and/or industrial property rights of Videoo.tv or of the owners of the same.

Therefore, the reproduction, transformation, public communication, distribution, making available to the public, and in general, any other form of exploitation, by any procedure, of all or part of the contents of Videoo.tv, as well as its design and form of presentation of the contents, without the corresponding authorization of the holder of the rights or unless it is legally permitted or is in accordance with the nature of the content itself, is prohibited.

The access to the Web or the Platform does not imply in any case, acquisition by the users of any property rights over the contents contained therein.

The user may not use the contents offered by Videoo.tv, for purposes other than those stipulated in these conditions, and where appropriate in the particular conditions governing the use of certain features of the same.

The inclusion of links or any type of connection to the Site from third party web sites is prohibited without the express written consent of Videoo.tv.

REMUNERATION OF VIDEOO.TV

The Publisher user will receive remuneration, provided that the terms of service have not been breached, on the agreed payment due date. All payments will be remitted in the currency indicated on the Platform.

Videoo.tv will issue self-billing showing the name, address and tax identification number, together with the other details that constitute a complete invoice for legal purposes for each period. Any changes to these details must be notified in order to continue with the self-billing.

Videoo.tv reserves the right to modify the final amount due to invalidations (due to fraudulent traffic, conversions above normal…). Users who have adopted an unauthorized implementation of the Platform will not be remunerated.

VIDEOO.TV TECHNICAL ASSISTANCE

The user of the Platform (Publisher) can ask DIGITAL GREEN SL (Videoo.tv) for technical assistance in order to insert the Videoo.tv tag and add Videoo.tv ads.txt lines on the Publisher’s website.

When the Publisher provides access to DIGITAL GREEN SL (Videoo.tv) for technical assistance to its website, template, WordPress or any part of its CMS for the placement of advertising, accepts that DIGITAL GREEN SL (Videoo.tv) perform the necessary operations to insert the advertisements and/or advertising videos in the specific place indicated by THE PUBLISHER (add lines in the Ads.txt file, enter video code with the necessary configuration so that the code appears in the areas of the web that are wanted, … ).

DIGITAL GREEN SL (Videoo.tv) will offer the service free of charge to the Publisher.

Under no circumstances DIGITAL GREEN SL (Videoo.tv) will be responsible for any damage. The Publisher undertakes, once the works are finished, to modify or delete the password and/or the access user to guarantee that it will eliminate the possibility of future accesses. Both parties undertake to make good use of the information and data provided by each of them, prohibiting its use or dissemination to third parties without the express consent of the one to the other.

LIMITATION OF LIABILITY

Liability for the use of the Web

The user is solely responsible for any infringements that may be incurred or damages that may be caused or caused by the use of the Web, being Videoo.tv exonerated from any kind of liability that may arise from the actions of the user.

The user is solely responsible for any claims or legal action, judicial or extrajudicial, initiated by third parties against Videoo.tv based on the user’s use of the Site. Liability for links

The present Web or/and the different actions that are developed in it, can incorporate links to other sites or pages, being these responsible for the contents in them lodged.

In addition, the existence of hyperlinks on third party web pages that allow access to this website does not imply in any case the existence of commercial or mercantile relations with the owner of the web page where the hyperlink is established, nor the acceptance by Videoo.tv of its contents or services.

Videoo.tv disclaims any responsibility for information found outside of the Site.

Videoo.tv disclaims any responsibility for the proper functioning of such links, the results obtained through such links, the accuracy and legality of the content or information that can be accessed and the damages that may be suffered by virtue of the information found on the linked website.

Liability for advertising

Videoo.tv disclaims any responsibility for any advertising content that may be contained in the advertising content of third parties or sponsors through the use of the Videoo.tv services. Videoo.tv shall not be liable for any use or damage that such advertising may cause to the user.

Part of the Web may host advertising or sponsored content. In that case, advertisers and sponsors will be solely responsible for ensuring that the material submitted for inclusion on the Web complies with the laws that in each case may be applicable. APPLICABLE LAW

If any court or regulator decides that any provision of these TOS is invalid, or otherwise unenforceable, such provision shall be severed and deleted from these TOS and the remaining terms shall continue to have full force and effect.

These General Conditions are governed by Spanish law.

Videoo.tv and the User, expressly waiving any other jurisdiction, submit to the Courts and Tribunals of the registered office of Videoo.tv for any dispute that may arise from the provision of services under these Terms of Service. In the case that the User is domiciled outside Spain, Videoo.tv and the User submit themselves, with express waiver of any other jurisdiction, to the courts and tribunals of the city of Huesca (Spain).
